Welcome, and thank you for choosing RentEye. These Terms of Service (“Terms”) constitute a legally binding agreement between you and Re Sp. z o.o. (“RentEye,” “we,” “us,” or “our”), a company registered in Poland with its registered office at Kolejowa 12E Street, 15-701 Białystok, Poland (court registration number: 0000787214, VAT number: PL 5423363617).
By creating an account, purchasing our hardware products, or accessing or using our cloud platform, mobile applications, or any other services we provide, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety, together with our Privacy Policy. If you are entering into these Terms on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case “you” shall refer to such entity.
If you do not agree to these Terms, you must not use our Services.
IMPORTANT NOTICE: Section 22 (“Dispute Resolution”) of these Terms contains a binding arbitration clause and class action waiver that materially affects your legal rights in the event of a dispute. Please read it carefully.
1. Introduction and Acceptance of Terms
These Terms govern your access to and use of the RentEye property monitoring system, including all hardware devices, firmware, cloud-based software, mobile applications, subscription services, and any other related services, features, or content provided by RentEye (collectively, the “Services”). These Terms apply to all users of the Services, including property owners, property managers, short-term rental operators, and any other individuals or entities that access or use the Services.
Your access to and use of the Services is conditioned upon your acceptance of and compliance with these Terms. By accessing or using the Services, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. We reserve the right to refuse service to anyone for any reason at any time.
2. Definitions
The following definitions apply throughout these Terms:

| “Platform” | The RentEye cloud-based software platform, accessible via our website and Mobile Applications, used for device management, monitoring, alerts, and property management. |
| “Mobile Applications” or “Apps” | The official RentEye mobile applications for iOS and Android operating systems. |
| “Services” | Collectively, the Devices, Platform, Mobile Applications, Subscription Plans, and all related features, content, and support services provided by RentEye. |
| “User” or “you” | The individual or legal entity that has purchased our Devices and/or registered an account to use our Services. |
| “Guest” | Any third party present at a property monitored by the RentEye Services, including but not limited to tenants, short-term renters, visitors, or invitees. |
| “Subscription” or “Subscription Plan” | The service plan selected by you, which determines the features and usage limits available to you and the associated recurring fees. |
| “Premium Features” | Specific features or functionalities of the Platform that are available only under paid Subscription Plans. |
| “Content” | All data, information, and materials generated by or through your use of the Services, including monitoring data, alerts, and device readings. |
3. Description of the RentEye Platform
RentEye provides an integrated property monitoring system designed for short-term rental operators, property managers, and homeowners. The Services are intended to help users protect their properties, prevent disturbances, and maintain good relationships with neighbors, while fully respecting the privacy of Guests.
Privacy by Design — No Audio Recording: The RentEye noise monitoring sensor measures ambient sound levels expressed in decibels (dB). The Device does not record, capture, store, or transmit any audio content, conversations, or voice data of any kind. The sole function of the noise sensor is to detect whether sound levels exceed a user-defined threshold and to generate an alert accordingly. This design principle is fundamental to our commitment to Guest privacy.
The Platform currently provides the following features: noise level monitoring and alerts, a monitoring dashboard, device management tools, and property management functionality. We may expand the Platform with additional features, including but not limited to occupancy monitoring, environmental sensing (temperature, humidity, air quality), and other smart property monitoring capabilities. Any such additions will be subject to these Terms.
The Services are intended for use in residential and short-term rental properties. They are not designed or intended for use in environments where the failure of, or errors or inaccuracies in, the Services could lead to death, personal injury, or severe physical or environmental damage.
4. User Accounts
To access the Platform, you must register for a user account by providing accurate, current, and complete information. You agree to maintain and promptly update your account information to keep it accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account, whether or not authorized by you.
You agree to notify us immediately at [email protected] of any actual or suspected unauthorized use of your account or any other breach of security. RentEye will not be liable for any loss or damage arising from your failure to comply with this obligation. We reserve the right to disable any user account at any time if, in our reasonable opinion, you have failed to comply with any provision of these Terms.
5. Devices and Hardware Products
Ownership and License. When you purchase a Device from RentEye, you acquire ownership of the physical hardware. However, the firmware, embedded software, and any software embedded in or bundled with the Device are licensed to you, not sold. All such software remains the exclusive intellectual property of RentEye and its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the firmware and embedded software solely in connection with the Device and the Services.
Installation and Use. You are solely responsible for the proper installation, configuration, and use of the Devices in accordance with our user manuals, installation guides, and any instructions we provide. Improper installation or use may result in inaccurate readings, missed alerts, or damage to the Device.
Hardware Restrictions. You may not, and you agree not to allow any third party to: (i) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying structure of any Device or its firmware; (ii) modify, alter, tamper with, repair, or create derivative works of any Device; (iii) remove or alter any proprietary notices, labels, or marks on any Device; or (iv) use the Device for any purpose other than its intended purpose as described in these Terms and our documentation.
Hardware Warranty. We warrant to the original purchaser that, when properly installed and used, if a Device fails due to defects in materials or workmanship within one (1) year from the date of purchase, we will, at our sole discretion, repair or replace the defective Device at no charge. This limited hardware warranty does not cover damage resulting from accident, misuse, abuse, neglect, unauthorized modification, unsuitable physical or operating environment, or improper installation. To the extent required by applicable mandatory law, the warranty period may be extended.
6. Software and Mobile Applications
License Grant. Subject to your compliance with these Terms and the terms of your active Subscription Plan, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Mobile Applications on devices you own or control, and to access and use the Platform, solely for your personal or internal business purposes in connection with the Services.
App Store Terms. The Mobile Applications are made available through the Apple App Store and Google Play Store. Your use of the Mobile Applications is also subject to the applicable terms and conditions of those platforms. Apple Inc. and Google LLC are not parties to these Terms and bear no responsibility for the Mobile Applications or their content.
Software Restrictions. You may not copy, modify, distribute, sell, sublicense, or lease any part of the Platform or Mobile Applications. You may not reverse engineer, decompile, or attempt to extract the source code of any software component of the Services, except to the extent that such restriction is prohibited by applicable law.
7. Subscription Services and Billing
Access to the full functionality of the Platform requires an active, paid Subscription. RentEye offers a range of Subscription Plans with varying features, usage limits, and pricing. The specific features included in each Subscription Plan are described on our website and are subject to change.
Billing Cycle. Subscriptions are billed in advance on a recurring basis (monthly or annually, as selected by you). Your Subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date. You are responsible for cancelling your Subscription if you do not wish to renew.
Payment. You must provide a valid payment method to activate a paid Subscription. By providing your payment information, you authorize RentEye (or our payment processor) to charge the applicable Subscription fees to your payment method on a recurring basis. All fees are stated exclusive of applicable taxes, which you are responsible for paying.
Fee Changes. We reserve the right to change our Subscription fees at any time. We will provide you with at least thirty (30) days’ prior written notice of any fee increase. Your continued use of the Services after the effective date of a fee change constitutes your acceptance of the new fees.
Refunds. Except as required by applicable law or as otherwise stated in our refund policy, Subscription fees are non-refundable.
8. Free Features and Premium Features
RentEye may make certain features of the Platform available free of charge (“Free Features”) and may offer additional features exclusively to users with paid Subscription Plans (“Premium Features”). The distinction between Free Features and Premium Features, and the allocation of features to specific Subscription Plans, is determined by RentEye in its sole discretion and is subject to change at any time. We reserve the right to convert Free Features to Premium Features, or to modify, limit, or discontinue any feature at any time, with reasonable notice to you.
9. Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services:
•in any way that violates any applicable local, national, or international law or regulation, including privacy, surveillance, and data protection laws;
•to monitor any individual without their knowledge or consent, where required by applicable law;
•to harass, abuse, harm, threaten, or intimidate any person;
•to interfere with or disrupt the integrity, security, or performance of the Services or any systems or networks connected to the Services;
•to attempt to gain unauthorized access to any part of the Services, other accounts, or computer systems or networks connected to the Services;
•to upload, transmit, or distribute any malicious code, viruses, or other harmful software;
•to use the Services as a substitute for a professional security system, fire alarm, smoke detector, or emergency response service; or
•to use the Services in any manner that could damage, disable, overburden, or impair our servers or networks.
10. Privacy and Data Processing
Our collection, use, and disclosure of personal information in connection with the Services is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to our data practices as described in the Privacy Policy.
GDPR Compliance. For users located in the European Union or the European Economic Area, RentEye processes personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (“GDPR”). You have the right to access, rectify, erase, restrict, or object to the processing of your personal data, and the right to data portability, subject to applicable law. UK Data Protection. For users located in the United Kingdom, RentEye processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
11. Guest Notification Responsibilities
You are solely and exclusively responsible for complying with all applicable laws, regulations, and platform rules governing the monitoring of your property and the notification of Guests. This obligation varies by jurisdiction and may include requirements to: (i) disclose the presence of monitoring devices in your property listing; (ii) obtain the informed consent of Guests prior to their arrival; and (iii) post physical notices within the property.
You acknowledge that laws regarding property monitoring, surveillance, and privacy differ significantly across jurisdictions and that it is your responsibility to obtain appropriate legal advice regarding your specific obligations. We strongly encourage you to inform all Guests, in clear and plain language, that a noise monitoring device is installed on the property, that it measures only sound levels and does not record audio, and that it is used to prevent disturbances.
RentEye expressly disclaims all liability for any claims, penalties, or damages arising from your failure to properly notify Guests or to comply with applicable laws regarding property monitoring.
12. Device Connectivity and Internet Requirements
The Services, including real-time monitoring and alert delivery, depend on a stable, continuous internet connection (Wi-Fi) at the property where the Device is installed. You are solely responsible for providing, maintaining, and paying for adequate internet connectivity. RentEye does not guarantee the performance of the Services in the absence of a stable internet connection and is not responsible for any failure to deliver alerts, data loss, or service interruptions caused by inadequate, unstable, or unavailable internet connectivity, power outages, or other infrastructure failures beyond our control.
13. Updates and Software Changes
RentEye continuously develops and improves the Services. We may, from time to time, release updates, upgrades, patches, or new versions of our firmware, Platform, or Mobile Applications. Such updates may be deployed automatically to your Device or account without prior notice. By using the Services, you consent to the automatic installation of updates. You acknowledge that certain updates may change the functionality of the Services, and that we are not obligated to maintain any particular feature or functionality.
We reserve the right to modify, suspend, or discontinue any part of the Services, including specific features or functionalities, at any time and for any reason, with or without notice. We will not be liable to you or to any third party for any such modification, suspension, or discontinuation.
14. Third-Party Integrations
The Services may integrate with or provide links to third-party platforms, applications, services, or websites (collectively, “Third-Party Services”), such as property management systems, booking platforms, or smart home ecosystems. RentEye does not control, endorse, or assume responsibility for any Third-Party Services. Your use of Third-Party Services is at your own risk and is subject to the terms and conditions and privacy policies of those third parties. We encourage you to review the terms and privacy policies of any Third-Party Services you use in connection with RentEye.
15. Intellectual Property
All rights, title, and interest in and to the Services, including all associated intellectual property rights, are and will remain the exclusive property of RentEye and its licensors. This includes, without limitation, all patents, copyrights, trademarks (whether registered or unregistered), trade secrets, know-how, the “RentEye” name and brand, the renteye.com domain name, all logos, designs, user interface elements, software, algorithms, and proprietary systems.
These Terms do not grant you any right to use RentEye’s trademarks, trade names, service marks, logos, domain names, or other distinctive brand features. Any feedback, suggestions, or ideas you provide to us regarding the Services may be used by us without any obligation to compensate you.
16. Warranty Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES (EXCLUDING THE LIMITED HARDWARE WARRANTY IN SECTION 5) ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. RENTEYE AND ITS AFFILIATES, PARTNERS, SUPPLIERS, AND LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT: (I) THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; (II) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (III) ANY ALERTS WILL BE ACCURATE, TIMELY, OR DELIVERED; OR (IV) ANY DEFECTS IN THE SERVICES WILL BE CORRECTED. ALERTS MAY BE DELAYED, INACCURATE, OR NOT DELIVERED DUE TO FACTORS INCLUDING BUT NOT LIMITED TO INTERNET CONNECTIVITY ISSUES, DEVICE MALFUNCTION, OR SYSTEM ERRORS.
THE SERVICES DO NOT CONSTITUTE A SECURITY SYSTEM, FIRE ALARM, SMOKE DETECTOR, OR EMERGENCY RESPONSE SERVICE AND MUST NOT BE RELIED UPON AS SUCH. RENTEYE IS NOT RESPONSIBLE FOR ANY DECISIONS YOU MAKE OR ACTIONS YOU TAKE BASED ON INFORMATION OR ALERTS PROVIDED BY THE SERVICES.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL RENTEYE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, PROPERTY DAMAGE, PERSONAL INJURY, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF RENTEYE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL RENTEYE’S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO RENTEYE FOR THE SERVICES IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE LIABILITY; OR (B) ONE HUNDRED EUROS (€100).
Force Majeure. RentEye shall not be liable for any failure or delay in performance of its obligations under these Terms arising from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, civil unrest, governmental actions, power failures, internet outages, or failures of third-party service providers.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, the above limitations will apply to the maximum extent permitted by applicable law.
18. Indemnification
You agree to defend, indemnify, and hold harmless RentEye and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys’ fees) arising out of or relating to: (i) your use of or access to the Services; (ii) your violation of these Terms; (iii) your violation of any applicable law or regulation, including any privacy or surveillance law; (iv) your failure to properly notify Guests of the presence of monitoring devices; or (v) your violation of any rights of a third party.
19. Suspension and Termination
Termination by You. You may terminate your account and Subscription at any time by contacting us at [email protected] or through your account settings. Termination will take effect at the end of your current billing period, unless otherwise required by law.
Termination or Suspension by RentEye. We reserve the right to suspend or terminate your access to the Services, in whole or in part, immediately and without prior notice or liability, for any reason, including if we reasonably believe that you have violated these Terms, engaged in fraudulent or illegal activity, or pose a risk to the security or integrity of the Services or other users.
Effect of Termination. Upon termination of your account for any reason: (i) your license to use the Services will immediately terminate; (ii) you will lose access to your account and all Content associated with it; and (iii) any provisions of these Terms that by their nature should survive termination shall survive, including Sections 15 (Intellectual Property), 16 (Warranty Disclaimer), 17 (Limitation of Liability), 18 (Indemnification), 21 (Governing Law), and 22 (Dispute Resolution).
20. Device Discontinuation
RentEye may, in its sole discretion, discontinue the manufacture, sale, or support of specific Devices or product lines. In such cases, we will endeavor to provide reasonable advance notice to affected users and will continue to support discontinued Devices for a commercially reasonable period following the announcement of discontinuation, subject to applicable law. We shall not be liable for any losses arising from the discontinuation of a Device or product line.
21. Governing Law
These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law principles.
The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply to these Terms or to any transaction contemplated herein.
22. Dispute Resolution
Informal Resolution. Before initiating any formal dispute resolution proceeding, you agree to first contact us at [email protected] and attempt to resolve the dispute informally. We will attempt to resolve the dispute within forty-five (45) days of receipt of your notice.
Binding Arbitration. If the dispute cannot be resolved informally, any dispute, controversy or claim arising out of or in connection with these Terms, or the breach, termination or invalidity thereof, shall be finally settled by arbitration in accordance with the Rules of Arbitration of the International Chamber of Commerce (”’ICC”’). The seat of arbitration shall be Warsaw, Poland, and the language of the arbitral proceedings shall be English.
Class Action Waiver. YOU AND RENTEYE AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.
EU Consumer Rights. If you are a consumer residing in the European Union, you may also submit a complaint through the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. Nothing in this Section shall affect your statutory rights as a consumer under applicable EU law.
23. Changes to the Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and, where practicable, by sending you an email notification at least thirty (30) days before the changes take effect. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Services.
